Medical Marijuana in Florida

Eligibility Requirements

1.  Be a current resident of Florida

2.  Have one of the following medical conditions previously documented by a physician (MD or DO) as stated in the Florida statute 381.986:  any symptom associated with cancer, amyotrophic lateral sclerosis (Lou Gehrig's Disease), AIDS, HIV+, glaucoma, Crohn's disease, epilepsy, multiple sclerosis, Parkinson's disease, post traumatic stress disorder, or chronic non-malignant pain due to any of the above. 

  • Other debilitating diseases that are of the same severity or symptoms as the above diseases including severe debility or pain due to any condition in the list below: 

  •  AIDS/HIV

  •  Amyotrophic Lateral Sclerosis (ALS)

  •  Anxiety Disorder

  •  Cachexia (Wasting Syndrome)

  •  Cancer/Tumor

  •  Cerebral Palsy

  •  Chronic Pain- severe intractable

  •  Crohn's Disease

  •  Cyclical Vomiting Syndrome

  •  Degenerative Disk Disorder with severe pain or debility

  •  Diabetes with severe peripheral neuropathy

  •  Epilepsy/Seizures

  •  Fibromyalgia with severe pain unresponsive to all other measures

  •  Glaucoma

  •  Herniated Disk with severe pain or dbility

  •  Lupus with severe arthritis due to Lupus

  •  Irritable Bowel Syndrome with severe intractable pain

  •  Lyme Disease with severe arthritic pain due to the Lyme disease

  •  Migraine headaches, intractable, severe, and failed other therapies

  •  Multiple Sclerosis

  •  Muscle Spasms severe intractable and failed other therapies

  •  Muscular Dystrophy

  •  Myasthenia Gravis with severe pain associated with myasthenia gravis

  •  Neuropathy (peripheral), severe and unresponsive to other measures

  •  Osteoarthritis severe, intractable , unresponsive to other measures

  •  Osteoporosis with severe pain unresponsive to other measures

  •  Polymyalgia Rheumatica

  •  Polymyositis with severe pain

  •  Parkinson's Disease

  •  Post Traumatic Stress Disorder (PTSD)

  •  Premenstrual Syndrome (PMS) with severe intractable pain unresponsive to all other measures

  •  Reflex Sympathetic Dystrophy

  •  Restless Legs Syndrome, severe, and unresponsive to three medications specifically for RLS

  •  Rheumatoid Arthritis with intractable severe pain unresponsive to NSAIDS, DMARDS, or biologics

  •  Scoliosis, without surgical options, and with severe pain documented due to the scoliosis

  •  Sickle Cell Anemia with severe pain associated with the sickle cell anemia episodes

  •  Spasticity, chronic, intractable, due to neurological disease

  •  Spinal Stenosis unresponsive to conservative measures, and documented as not a surgical candidate

  •  Other medical conditions of the same kind or class as those listed

3. Be examined in person by a qualified ordering physician that has taken the Florida approved studies and passed a medical registry test.  A current list of qualified physicians is listed here.  You MUST BRING DOCUMENTATION WITH YOU TO THE APPOINTMENT OF ONE OF THE DIAGNOSES ABOVE FROM ANOTHER PHYSICIAN IN ORDER TO OBTAIN A MEDICAL MARIJUANA USE CARD.

4. Have no contraindications to receiving marijuana

5. Once approved by the qualified ordering physician, the patients name and order for marijuana products will be entered into the Florida Medical Marijuana Use Registry.

6. Usually within 5 days you will receive an email from the Florida Medical Marijuana Use Registry with a password to allow you to login to the registry and submit your application to become a qualified patient.  Instructions on accessing the registry is located here.   Once logged into the registry, you may apply for registration as a qualified patient online.  The cost is $75 paid to the state.  

7. Once you have registered as a qualified patient, you will receive a qualified use patient card in the mail that will permit you to purchase marijuana from an authorized marijuana dispensing company.  

8. You will be re-evaluated in our office every 60-70 days in order to continue medical marijuana.  

9. Your medical registration as a qualified use patient is good for 210 days.  

IMPORTANT NOTES:

  • Marijuana is legal for medical use by Florida State Law when ordered by a qualified physician for qualified uses to a patient who must submit an application to the Florida Medical Use Registry, then purchase the product from an authorized medical marijuana dispensory.  

  • Marijuana is NOT legal under federal law, and the US Supreme Court has ruled that federal law trumps state law with respect to marijuana. 

  • The only reason medical marijuana is available is because of willful non-enforcement by federal prosecutors and agents.  This could change at any moment, making the acquisition of medical marijuana illegal, and the patients who possess it to be in violation of federal law, subject to arrest. 

  • There is actually only very low level scientific evidence that medical marijuana has any proven effectiveness and safety in only a few conditions.  The use of medical marijuana for most of the list of conditions approved by the State of Florida are not supported by scientific or medical research. Most uses in the expanded list have very little scientific evidence to support the use of marijuana.

  • Marijuana is not without addiction risk, even though that risk is low.  Compulsive use has been shown to lead to reduced mental capacity and functioning, increases in certain types of cancer (lip and oral pharynx), increase in asthma/bronchitis symptoms, and other problems. 

  • Under state law, it is not legal to smoke marijuana, even medical marijuana.  Other forms of administration must be used.

  • Hyperemesis syndrome is intractable nausea and vomiting associated with marijuana use that is extremely difficult to treat and frequently results in hospitalization. 

  • You may be a caregiver for someone using the medical marijuana (regardless of their age) and approved as a caregiver by the medical marijuana use registry. 

Cannabinoids in Marijuana (Cannabis)

Marijuana is derived from the flowers and leaves of the plants Cannabis sativa, Cannabis Indica, genetically modified and hybrid strains. Marijuana contains 150 different components.  40 of these are cannabinoids, that is active on the cannabinoid receptors in humans.  Of these cannabinoids, 8 are present in high enough concentrations to possibly be psychoactive.  They are THCA (tetrahydrocannabinol acid- the form THC occurs inside plants- THCA is converted into THC by heating the marijuana, cannabidiolic acid (CBDA) the form of CBD found in plants, delta 9-tetrahydrocannabinol- the primary psychoactive component in marijuana, delta-8 tetrahydrocannabinol, cannabidiol (CBD- converted from CBDA with heat- the primary therapeutic agent in marijuana), cannabigerol, and cannabinol (CBN).    Marijuana has these substances in varying proportions depending on the strain and whether it is deemed "medical marijuana" .  Some recreational marijuana strains have 20% THC and 1% CBD while medical marijuana strains may have 1% THC and 20% CBD.  Therefore it is important to know these ratios before beginning to use the products for medical purposes. The amounts of these are found on the packages of edible marijuana. It is illegal to send marijuana products through the mail containing more than 0.3% THC.  Cannabinoids act on the human cannabinoid receptors: CB1 and CB2.
